In order to survive, the PB has to remove him by any means, lawful or not. It is a win-win situation for the diocese, however. If he is "inhibited" by the PB, he thereupon becomes a martyr in the court of public opinion, which further degrades the TEC<br />position. The events Bishop Anderson describes may well happen, but not for at least another six months, given that the House of Bishops does not meet again until next March. And I would expect that by that time the diocesan treasurer will have moved the critical accounts to safer depositories than the big banks and brokerages which ECUSA so easily can manipulate, given the millions and millions which it keeps on deposit with them itself.<br /><br />The bottom line for South Carolina is that the Dennis Canon is legally a dead letter there. So ECUSA will not be able, in this instance, to make its usual claims of "trust" based on that Canon. And given that the Diocese itself predates ECUSA, an "implied trust" theory is going to be a huge uphill slog, as well. Finally, the lesser-noticed aspect of the <i>All Saints Waccamaw</i> opinion provides very good protection for the Diocese to maintain its legal integrity, as well. It will be the entity which strictly follows the Canons of the Diocese of South Carolina. Any Potemkin prop-up concocted by ECUSA will have no prior legal history, will not have come into being by following either ECUSA's own or the diocesan Canons, as well, and will have no ability to claim that it is the still-existing larger entity in disguise. The best canon lawyers in the Church are in South Carolina, and they are <i>not</i> on ECUSA's side.A. S. Immediately, they will authorize a few loyalist individuals to take signature cards to all of the banks that hold diocesan assets, and present the new cards as replacement cards for the "former" signatories. This is called an ecclesiastical coup d'état.<br /><br />If the bank protests, the new officials will advise the bank that they could be held liable for any losses caused by their failure to recognize the lawful signatories, and especially if they permit the former signatories to have access to any of the funds or assets held by that bank.
