Yet he is precisely the person whom Judge Goodstein wrote in her injunction had the authority *to* use the name and marks of the diocese? If that case is stayed pending the outcome of the state suit, I can't imagine Judge Goodstein being favorably impressed that a defendant in one case is suing over the same name and trademarks except at the federal level?? Will she learn of that federal law suit?? Just curious.
SC Blu Cat LadyGallettahttps://www.blogger.com/profile/07062791988762007882noreply@blogger.comtag:blogger.com,1999:blog-759178030677978044.post-22233098179630673962013-06-11T11:13:25.296-07:002013-06-11T11:13:25.296-07:00Mr. Haley--It's been surprising to me how TECU...Mr. Haley--It's been surprising to me how TECUSA has fared to the extent it has in litigation in the past several years; perhaps the best analogy is to a house built on sand--the structure may somehow be supported to an extent for some time, however, with the passage of time, the support won't last. Your post on the "Accord" with TECUSA's bishops illustrates that TECUSA's litigation strategists are probably very concerned about potential weaknesses relating to positions and tactics they have adopted, and thus one sees the emergence of apparent fear relating to pending legal matters in which TECUSA is involved. I believe this will be followed by others, and by courts in other jurisdictions, with unfavorable results to positions and tactics adopted by TECUSA, and this decision should be a wake-up call for the Presiding Bishop, as one who should realize her duty is to be above resorting to quick-fix, facile approaches to problem-solving involving her denomination.williamphttps://www.blogger.com/profile/15462159892385010372noreply@blogger.comtag:blogger.com,1999:blog-759178030677978044.post-72143730931395837352013-06-11T08:44:10.076-07:002013-06-11T08:44:10.076-07:00Bryan, yes, it's too early to speculate. Filing pleadings in federal court, for instance, is a right guaranteed under the First Amendment, and so they might get a pass on that.

The real test will be in how they conduct themselves going forward.A. There was much prayer over this hearing and Judge Houck. It is widely known here that Judge Houck is very liberal in his politics ( He was the judge for the Citadel case some years back). Because of his known liberal views, there was some angst among my friends who knew him well.
Glad he was able to put politics aside and follow the legal precedents and the law. That is reassuring. Next.... It will be interesting to see what happens with the case back in the hands of Judge Goodstein.
SC Blu Cat LadyGallettahttps://www.blogger.com/profile/07062791988762007882noreply@blogger.com
